Brooke A. Howard

Brooke Albert Howard is a Raleigh trial lawyer who focuses her practice on representing individuals who have been seriously harmed-- either physically or financially. Brooke has over ten years of experience in complex civil litigation. Over the years, she has handled a wide-range of cases, including investment fraud matters, shareholder actions, wrongful death actions, catastrophic personal injury actions, uninsured and underinsured motorist claims, and product liability actions.

Although Brooke now primarily represents plaintiffs, she has previously represented defendants and insurance companies and has also worked for a state appellate court judge. Brooke’s prior work experience gives her the unique ability to evaluate her cases from all angles and to anticipate arguments that may be raised by the other side.

  • Obtained confidential settlement, in excess of net out-of-pocket losses, on behalf of clients with retirement portfolio that was over-invested in high-risk, unsuitable emerging market funds.

  • Featured in NC Lawyers Weekly Top Verdicts and Settlements of 2013 for $2 Million settlement obtained in product liability action.

  • Survived Motion to Dismiss and obtained confidential settlement on behalf of minority shareholders/founders of company in Delaware Court of Chancery action; Carsanaro, et al. v. Bloodhound Tech., Inc. et al., C.A. No. 7301-VCL  http://courts.delaware.gov/opinions/download.aspx?ID=186730. This case has been discussed in the New York Times, Deal Book, and the favorable ruling that was obtained for Brooke’s clients has impacted corporate law across the country.

  • Obtained confidential settlement in product liability action involving a motorcycle accident in which one person was killed and another sustained a serious brain injury.

  • Represented six Iraqi civilians in personal injury/wrongful death actions against Blackwater/Xe Services arising from the September 16, 2007 Nisur Square shootings in a Baghdad, Iraq, which made international news. The case was vigorously litigated in both federal and state courts, before reaching a confidential settlement. 

  • Obtained confidential settlement on behalf of a group of retired investors whose investment advisors had engaged in fraud and had lost the majority of clients’ retirement savings in extremely risky and unsuitable investments.

  • Obtained limits of all applicable auto policies for law enforcement officer injured in high speed car chase.

  • Obtained limits of all applicable auto policies for bicyclist hit by car.

  •  Obtained Summary Judgment in favor of maintenance contractor client accused of negligence.

  • Obtained Summary Judgment in favor of HVAC manufacturer client in a product liability action.
